Rules for using this platform

Please read these Terms carefully. They contain important provisions governing user submissions, editorial rights, disclaimers, limits of liability, indemnification, and individual dispute resolution. By accessing the Services, signing the petition, or submitting a report, you agree to these Terms and acknowledge the Privacy Policy.

1. Agreement and purpose

These Terms of Use (“Terms”) are a binding agreement between you and the operator of No Swim With Pigs (“Campaign,” “we,” “us,” or “our”). They govern the website, petition, report-submission tools, public community stories, uploaded media, resource library, administrative functions, and related features (collectively, the “Services”). If you do not agree, do not use the Services.

The Services support public-interest advocacy and allow users to petition, share first-person experiences, submit information privately, and access resources concerning animal welfare, food and water safety, guest safety, sexual misconduct, tourism operations, and related issues associated with swimming-with-pigs experiences and travel in The Bahamas.

2. Eligibility and changes

You must be at least 18 years old and legally able to enter a binding agreement to use submission features. If you use the Services for an organization, you represent that you have authority to bind it.

We may modify the Services or these Terms at any time. Updated Terms apply prospectively when posted unless a later date is stated. Continued use after the effective date constitutes acceptance where permitted by law. If a material change requires additional consent, we will request it. We may suspend or discontinue any part of the Services without notice or liability.

3. Your submissions and promises

“Submission” means anything you send through or in connection with the Services, including a petition signature, report, story, message, link, photo, video, caption, file, correction, or other material.

For every Submission, you represent and warrant that:

  • the Submission reflects your honest belief and, when presented as firsthand, your own experience or direct observation;
  • you will distinguish personal knowledge from rumor, assumption, or information learned from someone else;
  • you have all rights, permissions, and lawful authority needed to provide the Submission and grant the licenses in these Terms;
  • your Submission does not knowingly contain a materially false statement, fabricated evidence, unlawful threat, harassment, hate speech, impersonation, malicious manipulation, or content intended primarily to injure someone through deception;
  • your Submission does not unlawfully invade privacy, violate confidentiality, infringe intellectual-property or publicity rights, obstruct justice, or breach a court order or binding legal duty;
  • you will not identify a victim, minor, or other private individual, or upload identifying media about them, without lawful authority and informed permission;
  • you will not submit intimate images, sexual imagery, child sexual-abuse material, passwords, identity documents, financial-account data, malicious code, or private medical records; and
  • media is authentic to the best of your knowledge and any material alteration, reenactment, synthetic content, or AI generation is clearly disclosed.

You are solely responsible for your Submission and any consequences of providing it. Do not submit anything that would place you or another person in danger. A private report is not a privileged communication, police report, legal filing, medical record, or confidential attorney-client communication.

4. Ownership and the rights you grant us

You retain whatever ownership rights you hold in your original Submission. You also grant us the permissions below, which are necessary to operate, protect, and promote the Campaign.

License for every Submission

You grant the Campaign a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, transferable license to host, store, reproduce, preserve, secure, scan, analyze, moderate, translate, transcode, format, adapt, redact, excerpt, summarize, categorize, create internal or de-identified derivative materials from, and otherwise process the Submission to operate the Services, prevent abuse, respond to you, comply with law, investigate disputes, protect safety, and establish or defend legal rights. This operational license lasts for as long as reasonably necessary for those purposes, including backups, archives, and legal holds.

Additional license when you select public posting

If you select the public-posting option, you additionally grant the Campaign a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid, sublicensable, and transferable license to publish, publicly display, publicly perform, reproduce, distribute, transmit, syndicate, quote, excerpt, edit, adapt, translate, caption, combine with other material, promote, archive, and create derivative works from the public portions of the Submission in any current or future medium for advocacy, education, journalism, research, fundraising, publicity, and promotion of the Campaign or its mission.

This public license survives removal of the original post for copies, excerpts, campaign materials, research, archives, backups, legal records, and distributions made before removal. To the extent permitted by law, you waive and agree not to assert moral rights or similar rights against uses authorized by these Terms. You authorize us to identify a public report as submitted by an “Anonymous community member” and to use the non-identifying context you provided.

No obligation to compensate or use

Unless we separately agree in a signed writing, no Submission is confidential business information, no compensation or attribution is owed, and we have no obligation to use, publish, return, preserve, investigate, or respond to it. You release the Campaign from claims based solely on editing, non-publication, authorized publication, redistribution, or removal consistent with these Terms and your selections, to the fullest extent permitted by law.

5. Editorial discretion and moderation

We have sole editorial discretion over the Services. We may, but are not required to, review, verify, fact-check, redact, blur, crop, edit, label, delay, refuse, disable, restrict, preserve, disclose where lawful, or remove any Submission or account of an event at any time, with or without notice, for any lawful reason. Reasons may include safety, privacy, legal risk, authenticity, relevance, duplication, quality, space, technical limits, changing editorial priorities, or violation of these Terms.

Manual review and moderation cannot detect every problem. Publication does not mean that we endorse a user, independently verified every assertion, reached a legal conclusion, or found any person or organization liable. A location, company, cruise line, resort, ship, government body, or other organization appearing in navigation, coverage labels, reporting context, or a user Submission is not by itself an allegation or finding that the organization committed, concealed, knew of, or was legally responsible for misconduct.

We may correct or remove content in response to a credible request, but we are not required to adjudicate disputes or publish rebuttals. Send a specific correction or removal request to legal@noswimwithpigsbahamas.com.

6. Acceptable use and enforcement

You may not misuse the Services, interfere with their operation, evade rate limits, probe security, scrape at unreasonable volume, harvest personal information, submit spam, automate fraudulent signatures, introduce malware, impersonate another person, retaliate against a submitter, attempt to identify an anonymous source, or use the Services to facilitate unlawful conduct.

We may investigate suspected violations; preserve relevant information; block devices, networks, files, or requests; restrict access; and refer matters to service providers, affected parties, or authorities where we reasonably believe it is lawful and appropriate. You receive no ownership interest in the Services, our branding, design, databases, curation, original writing, or software. All rights not expressly granted are reserved.

7. Safety and professional-service disclaimers

The Services are not an emergency line, law-enforcement agency, medical provider, attorney, victim-services provider, government body, regulator, travel agent, cruise or resort complaint department, food-safety authority, or animal-welfare investigator. Submitting information here does not notify any of those entities, preserve a legal deadline, start an investigation, create an attorney-client relationship, or guarantee assistance.

Travel, swimming, wildlife interaction, consuming food or water, and relying on third-party operators involve risks. Information on the Services is general advocacy and educational material, not medical, legal, travel, veterinary, food-safety, security, or other professional advice. Official conditions, advisories, laws, and emergency information can change. Verify current information with qualified professionals and official sources before making decisions.

8. Third-party material, links, and names

The Services may link to or discuss third-party articles, advisories, social posts, maps, companies, brands, destinations, or services. Third-party material is provided for context and convenience. We do not control or guarantee its accuracy, availability, safety, legality, policies, or continued existence. Linking, naming, or discussing a third party does not imply affiliation, sponsorship, endorsement, or a legal finding.

All third-party names and marks belong to their respective owners. Referencing them for identification, commentary, criticism, reporting, or public-interest discussion does not claim ownership or affiliation.

9. Service provided “as is”

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. THE CAMPAIGN DISCLAIMS WARRANTIES OF ACCURACY, COMPLETENESS, RELIABILITY, TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, SECURITY, AVAILABILITY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE.

We do not warrant that the Services will be uninterrupted, error-free, secure, anonymous, free of harmful components, or that content will be preserved, published, corrected, removed, or achieve any advocacy, regulatory, legal, safety, or commercial result. Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE CAMPAIGN AND ITS OPERATORS, AFFILIATES, SPONSORS, LICENSORS, SERVICE PROVIDERS, MODERATORS, VOLUNTEERS, ADVISERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS (THE “CAMPAIGN PARTIES”) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, ENHANCED, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, DATA, REPUTATION, OPPORTUNITY, OR GOODWILL; PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM THIRD-PARTY CONDUCT; OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE CAMPAIGN PARTIES' TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.

These limitations apply to all theories of liability and even if a remedy fails of its essential purpose. They do not limit liability that cannot lawfully be excluded, which may include liability for intentional misconduct or certain personal injuries depending on applicable law.

11. Indemnification

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless the Campaign Parties from claims, demands, proceedings, damages, judgments, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: your Submission; your breach of these Terms; your misuse of the Services; your violation of law or another person's rights; or a dispute between you and a third party. You may not settle a covered claim in a way that admits fault by or imposes obligations on a Campaign Party without our written consent. We may control the defense of a matter at your expense, and you will reasonably cooperate.

12. Disputes, arbitration, and class-action waiver

Please read this section carefully. It affects how disputes are resolved and limits the ability to bring a class or jury action, where enforceable.

Informal resolution first. Before filing a claim, each party must send a written notice describing the dispute and requested relief to legal@noswimwithpigsbahamas.com and allow 30 days for a good-faith attempt to resolve it. This does not prevent either party from seeking urgent temporary injunctive relief.

Individual arbitration. Except for an eligible individual small-claims action or a claim seeking temporary or preliminary injunctive relief for misuse, security, confidentiality, or intellectual-property harm, any dispute arising from these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its then-current Consumer Arbitration Rules. The Federal Arbitration Act governs this arbitration provision. The arbitration may occur by video, telephone, documents, or in person as the rules permit. The arbitrator may award the same individual relief a court could award but may not combine claims or preside over a representative or class proceeding.

No class or jury proceedings. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND THE CAMPAIGN WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE ACTION. Claims may be brought only in an individual capacity.

Thirty-day opt-out. You may opt out of arbitration by emailing legal@noswimwithpigsbahamas.com within 30 days after first accepting these Terms. Include your name, the email used with the Services (if any), and a clear statement that you opt out of arbitration. Opting out does not affect other Terms.

If arbitration does not apply. A dispute that is not subject to arbitration must be brought exclusively in a court of competent jurisdiction serving the place where the Campaign operator has its principal place of business, and each party consents to personal jurisdiction and venue there, except where applicable consumer law requires otherwise. These Terms are governed by the laws of that jurisdiction, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs arbitration.

13. General terms

These Terms and the Privacy Policy are the entire agreement concerning the Services and supersede prior discussions about them. If a provision is unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. If the class-action waiver is found unenforceable for a particular claim, that claim will proceed in court rather than class arbitration.

Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our consent. We may assign these Terms, including in connection with a reorganization, sponsorship, financing, sale, or transfer of the Campaign or its operations. We are not liable for delay or failure caused by events beyond reasonable control. Section headings are for convenience. Provisions that by their nature should survive—including licenses, disclaimers, liability limits, indemnification, disputes, and general terms—survive termination.
